The following dispositions were recently filed in Portales Magistrate Court:


May 20

• Jerry Ferguson, 52,  guilty, driving under the influence of intoxicating liquor or drugs (1st). Sentence:  90 days, with 88 days suspended, credit for time served  leaving  41 hours to be served in Roosevelt County Detention Center. One year supervised probation, Attend ASPEN program, complete DWI school, 24 hours community service, pay court cost, fines and fees.

• Ariadna Nieto, 34, guilty, aggravated driving while under the influence of intoxicating liquor or drugs (1st). Sentence:  90 days with 88 days suspended, credit for time served, leaving 38 hours to be served at RCDC. One year supervised probation, attend ASPEN program, DWI school, 48 hours community service, pay court cost, fines and fees.

• Jake Armijo, 41, guilty, battery against a household member. Sentence: 364 days supervised probation, attend ASPEN program, pay court cost, fines and fees.


May 28

• Maria Diaz, 33, guilty, aggravated driving under the influence of intoxicating liquor or drugs (1st). Sentence: 90 days, with 88 days suspended leaving two days to be served at RCDC, one year supervised probation, attend ASPEN program, complete DWI school, 48 hours community service, pay court cost, fines and fees.

• Gloriann Melgarejo, 39, guilty, driving under the influence of intoxicating liquor (1st). Sentence: one year supervised probation, attend ASPEN program, DWI school, 48 hours of community service, pay court cost, fines and fees.

• Paul Martin, 41, guilty, driving under the influence of intoxicating liquor (1st). Sentence: 90 days suspended sentence, one year supervised probation, attend ASPEN program, DWI school, 24 hours community service, pay court cost, fines and fees.

• Cosme Vicuna, 42, guilty, phone harassment. Sentence: 364 days supervised probation, attend ASPEN program, pay court cost, fines and fees.

• Josie Gutierrez Encinias, 53, guilty, battery. Sentence: 182 days supervised probation, attend ASPEN program, pay court cost, fines and fees.

• Jacqueline Peterson, 24, guilty, embezzlement. Sentence: 364 days unsupervised probation, attend ASPEN program, pay restitution pay court cost, fines and fees.


May 29

• Roberto Nieto, 32, guilty, driving under the influence of intoxicating liquor (2nd). Sentence: 364 days, with 356 days suspended leaving eight days to be served at RCDC, two years supervised probation, attend ASPEN program,  complete 48 hours community service, pay court cost, fines and fees.

• Vickie Harbour, 47, guilty,  concealing ID. Sentence: pay court cost, fines and fees.


June 1

• Amanda Daugherty, 20,  guilty, possession of drug paraphernalia. Sentence: pay court cost, fines and fees.


June 2

• Shawn Burrow, 42, guilty, driving under the influence of intoxicating liquor (1st), open container and possession of marijuana less than an ounce. Sentence: 90 days suspended for DWI (1st), 15 days suspended for possession, one year supervised probation, attend ASPEN program, DWI school, 24 hours community service, pay court cost, fines and fees.

June 4

• Brandon Ashmore, 20, guilty of driving under the influence of intoxicating liquor (1st). Sentence: 90 days suspended, one year supervised probation, attend ASPEN program, DWI school, 24 hours community service, pay court cost, fines and fees.

• Stephen Rittereiser , 23, guilty, driving under the influence of intoxicating liquor (1st), resisting, evading, obstructing an officer. Sentence: one year supervised probation, attend ASPEN program, DWI school, 48 hours community services, pay court cost, fines and fees.

• Oscar Lozano, 26, guilty, driving  under the influence of intoxicating liquor (2nd). Sentence: 364 days, with 360 days suspended sentence, four days to be served at Roosevelt County Detention Center, two year supervised probation, attend ASPEN program, 48 hours of community service, pay court cost, fines and fees.

• Oracio Ornelas, 28, guilty, possession of drug paraphernalia and resisting, evading and obstructing an officer. Sentence:  364 days supervised probation, attend ASPEN program, pay court cost, fines and fees.

• Phillip Smith, 20, guilty, driving under the influence of intoxicating liquor (1st) roadways laned for traffic. Sentence: one year supervised probation, attend ASPEN program, 24 hours of community service, pay court cost, fines and fees.

• Russell Scott Smart, 20, guilty, aggravated driving while under the influence of intoxicating liquor (1st). Sentence: 90 days,  all but two days suspended, one year supervised probation, attend ASPEN program, 48 hours of community service, pay court cost fines and fees.

• Chelsey Aguirri, 19, guilty, assault. Sentence: 182 days supervised probation, attend ASPEN program, pay court cost, fines and fees.

• Kenneth Taylor, 24, guilty, disorderly conduct and assault. Sentence: 182 days unsupervised probation, attend ASPEN program, pay court cost, fines and fees.

• Barbara Ann Ortiz, 48, guilty, battery. Sentence: six months unsupervised probation, attend ASPEN program, pay court cost, fines and fees.

• Timothy Roberts, 44,  guilty,diving under the influence of intoxicating liquor.  Sentence: one year supervised probation, attend ASPEN program, complete DWI school, 24 hours community service, pay court cost, fines and fees.


June 8

• Vincent M. Gonzales, 18, guilty, possession of marijuana less than an ounce. Sentence: pay court cost, fines and fees.

June 10

• Orlando Ornelas, 39, guilty, driving under the influence of intoxicating liquor (2nd). Sentence: 364 days, with 360 days suspended, leaving four days to be served at RCDC, two years supervised probation, attend ASPEN program, 48 hours community service, pay court cost, fines and fees.


June 15

• Jarrett Lovelance, 19, guilty, minor in possession of alcohol. Sentence: one year supervised probation, attend ASPEN program, 30 hours of community service, pay court cost, fines and fees.

• Ryan Jackson, 20, guilty, minor in possession of alcohol. Sentence: one year supervised probation, attend ASPEN program, 30 hours community service, pay court cost, fines and fees.
